The firm recently completed a jury trial involving a suit to obtain payment for the firm’s client against a homeowner who refused to pay for a change order authorized by the homeowner’s representative to install an exterior video surveillance system during the course of a multi million dollar home remodeling project. After the firm filed suit to obtain payment of the change order the homeowner, in turn, filed a cross-complaint for construction defects related to the same work performed under the change order. At trial, the firm presented expert testimony which showed that the exterior video surveillance system was performing exactly as designed and installed and that the homeowners’ complaints regarding the system lacked any credibility. After a two-week trial, the jury came back with a verdict after deliberating for less than two hours, awarding the full amount of contract damages being sought to the firm’s client and awarding no damages to the homeowner for the construction defect claims. After trial, the firm also successfully obtained a further award for attorneys fees and costs for its client.
