Ramey Law P.C. obtain a favorable settlement for a homebuilder by developing a reasonable cost of repair accepted by the homeowner and maximizing funding of the settlement by subcontractors and suppliers

Ramey Law P.C. recently represented a general contractor sued by a homeowner in connection with a large, remodeling project on a water view home. The homeowner had sued the firm’s client as a result of water intrusion into the home at multiple locations, and was initially seeking over one million dollars in repair costs and relocation damages. The firm retained a team of experts to aggressively investigate the defect claims and to develop a reasonable cost of repair for the construction defects while at the same time pursuing the specialty contractors and material suppliers whose defective work and materials had contributed to the claims.
Despite there being no written contracts with any of these parties which required them to indemnify the firm’s client, the firm was able to negotiate a settlement with the homeowner for approximately one-third of the amount of the original demand and was able to obtain contributions from the specialty contractors and material suppliers for approximately one-half of the total settlement amount.
